Leading video games publisher and developer Namco Bandai Games America Inc. announced it has filed suit against Eagle Distributing Inc.

Namco Bandai’s complaint alleges that “Eagle is making, advertising, selling and distributing counterfeit Namco videogames and videogame consoles” without authorization.

The complaint further alleges that Eagle’s advertising, sale and distri-bution of its “Ms. Pac-Man and More” console and similar products – including its “GameboX Multi-Game Arcade Systems” and its portable “arcade station” console that plugs directly into a TV or video monitor – does not reflect Eagle’s mere “refurbishment” of videogame consoles originally sold by Namco or Namco Bandai’s former licensee, Bally Midway Manufacturing Co.

The company’s complaint seeks damages, including whatever profit that Eagle Distributing has realized through its unauthorized advertising, sales and distribution of infringing videogames, arcade consoles and similar products, a seizure order and an injunction against any such further activity.
